The terms “we,” “us,” and “our” in this policy refer to any businesses operating under one or more of the following names: “Taxpert Accounting,” “CIB Private Wealth Services,” “CIB Finance,” “Artificial Intelligence Specialists,” and include any associated partnerships, trusts, and corporate entities.

The responsibilities Taxpert Accounting has for handling the personal data we have on our clients, prospective clients, contractors, and other parties are described in this policy. This covers data that can be used to reasonably identify an individual, either directly or indirectly, such as your name, email address, identification number, or any other kind of information. The provisions of the Acts themselves cannot be replaced by this policy, nor is it meant to.

Acts or procedures that have a direct connection to the personnel records of either current or past workers are exempt from the Privacy Policy.

This may entail the following:

  • managing, researching, and developing our goods and services;
  • giving you information about our goods and services, inviting you to events or sending out articles or publications;

We retain the right to transfer our user databases, along with any personal and non-personal information contained in them, to the extent permitted by law in the event of a change of ownership in our company or a sale or transfer of business assets.

How your personal information is gathered by us

You may provide personal information to Taxpert Accounting in a number of ways, such as when you communicate with us online or in person. This applies to, among other things, responding to surveys and/or promotions, providing financial or credit card information, changing your content or email preferences, providing feedback, sharing information about your personal or commercial affairs, and communicating with your adviser.

In the event that we obtain personal information from third parties, we will safeguard it in accordance with this Privacy Policy. You are free to object to our request for permission to obtain information from a third party.

You might occasionally give us personal information about someone else, such other family members. If you don’t have their permission, you can’t give us that information. Additionally, you must to take appropriate action to notify them of the information contained in this privacy policy.

Risky information

A portion of the personal data meets the Privacy Act’s definition of “sensitive information.” Health information, details about your racial or ethnic origin, political beliefs, religious beliefs, participation in a trade union or other professional or trade association, sexual preferences, and criminal history are all considered sensitive information. We will only gather this data in accordance with the Privacy Act’s authorisation.

Unless you agree otherwise or in some other restricted situations, sensitive information will only be used and disclosed for the reason for which it was submitted or a directly linked secondary purpose (e.g. where required by law).

Unwanted personal data

We might occasionally acquire personal information about people that we did not ask for. In the event that this happens, we will assess whether the collection is mandated or permitted by Australian law, a court or tribunal order, or if we have your consent and the information is required for us to perform our services. If so, the data will be handled in compliance with the Australian Privacy Principles as though it had been requested.

We shall destroy or de-identify the information as soon as it is reasonably possible, providing that doing so is permitted by law, if it is found that you have not given us consent to receive it and that there is no legal obligation for us to collect it.

Disclosure of personal information

It could be necessary for us to give personal information to a third party in order to provide our services. To the extent that it is allowed by law and specified in this Policy, this will be carried out.

Those who are members of the Taxpert Accounting Group are examples of the kinds of third parties to whom we may disclose personal information.

  • Businesses or people hired to help us with services or who carry out tasks on our behalf (such as mailing houses, expert consultants, barristers, and solicitors, contractors, or temporary workers to handle peak period workloads, information technology service providers, trustees of superannuation funds, insurers, fund managers, and other product providers).
  • Courts, tribunals, and regulatory authorities, as required or authorised by law and in compliance with the Code of Ethics for Professional Accountants.
  • compliance officers or auditors, as mandated by professional associations or the law
  • anybody else, including banks, accountants, and other financial institutions, with whom you have given permission.

In order to maintain continuous adherence to mandatory professional standards, we are required by the Financial Planning Association of Australia’s Code of Professional Practice to make certain information available for inspection by the Association upon request when providing Wealth Advisory services to you. The Australian Securities and Investments Commission has also been given access to certain personal information about you that is stored in our files by virtue of the Corporations Act. When an inspection of this kind occurs, it might be necessary to give Australian Securities and Investments Commission representatives access to your personal data.

Unless you specify otherwise, we will assume that if you hire us to handle your tax affairs, you have given us permission to deal directly and on a day-to-day basis with the Australian Tax Office (the “ATO”), the New Zealand Inland Revenue, or any other taxation agency in a foreign jurisdiction. In the event that these organisations ask for information about you that we feel is outside the purview of our power—for example, a Tax Office audit—we will first ask for your express authority before granting the request.

We must completely cooperate if we are compelled by law to divulge information about you or your company. However, we will notify you that the information has been disclosed when it is practical and legal for us to do so.

Protection of your private data

Taxpert Accounting is dedicated to making sure that the data you give us is kept safe. We have implemented the necessary administrative, electronic, and physical measures to safeguard and secure information and prevent misuse, interference, loss, and unauthorised access, modification, and disclosure in order to prevent unauthorised access or disclosure.

In addition to undergoing privacy and data protection training, our staff members are expected to respect the privacy of persons and the confidentiality of personal information. All workers must read this policy and comprehend their responsibilities with regard to personal information as part of that training.

Every year, all staff members must attest that they have followed this policy in its entirety and have kept themselves informed of any modifications.

We only use data processors who abide by the regulations set forth by the GDPR and the Australian Privacy Act, and who have put in place sufficient technical safeguards to prevent unauthorised use, loss, and theft of personal data, when we hire them to process personal data on our behalf.

You bear all risk associated with the transmission and sharing of information. We are unable to ensure that any information you send or receive from us is secure. We cannot guarantee that the personal information we collect won’t be revealed in a way that is contrary to this privacy policy, even while we take precautions to prevent unauthorised disclosures of information.

Preservation of your private data

In line with our documentation retention policy, the law, and the Australian Privacy Principles, we will only keep your personal information for as long as it takes to accomplish the reason it was acquired.

Hosting and Global Data Transfers

In order to accomplish the purpose for which the personal information was obtained or a connected purpose in compliance with the Privacy Act, we may disclose your personal information to organisations overseas, depending on the nature of the engagement or the circumstances surrounding the collection of the personal information. These could include, but are not restricted to, Malaysia, the Philippines, India, Australia, and New Zealand.

Australia is home to Taxpert Accounting’s offices and/or facilities. We have contractors and suppliers in Malaysia, New Zealand, and Australia. Australia is home to our website’s hosting facilities. Additionally, we might use servers located abroad to store, process, or backup your personal data (including through third party service providers). Malaysia is where these servers are typically found, however they are not the only ones.

The use of standard data protection clauses adopted or approved by the European Commission, which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from our Privacy Officer (see contact details below) are just a few of the appropriate safeguards that will protect data transfers to each of these countries.

You understand that any personal information you submit for publication through our website or services could be seen globally by anyone with internet access. We have no control over how others may use or misuse such personal information.

There will be situations where sharing the information is mandated or permitted by Australian law, a court or tribunal ruling, the Professional Accountants Code of Ethics, DFK ANZ as a component of their quality review program, or where you have explicitly consented to sharing the information.

Obtaining access to your personal data

In compliance with the terms of the Privacy Act 1988 (Cth) and, where applicable, the EU GDPR, you have the right to see details of the personal information that we maintain on you. Please send an email to privacy@cibaccountants.com.au if you would like a copy of the information we have on you or if you think any of it is false, outdated, incomplete, irrelevant, or deceptive.

You will need to authenticate your identity and let us know what details you need.

We reserve the right, under certain conditions outlined in the Privacy Act or any other applicable law, to refuse to give you access to the information we may have about you. In the event that access is refused, we will provide an explanation.

We make every effort to reply to your request for information on the personal data we maintain; nevertheless, please be aware that the processing of your request might take some time, as access to the data may need to be obtained from our archives.

While we will make every effort to give you access to the personal information we have on file without charge, we do retain the right to charge you a fee for this service. Should we decide to impose a fee, we will notify you beforehand.

Maintaining current personal information

We make every effort to guarantee that the personal data we have is true, comprehensive, and current. It is certain that changes will be needed, and mistakes will inevitably happen occasionally. Should any of the personal information we have on you change, please get in touch with us right away.

  • we handle your personal data in our capacity as a Controller under the GDPR, as well as in our capacity as a Processor.

  • We will only gather your personal data for a specified purpose with your express consent, and the amount of data we collect will only be what is required—not more—for that reason. We promise to protect and secure your data.

Additionally, if processing your personal data is required to further our legitimate interests or to carry out a duty imposed by law or contract, we shall do so.

  • If processing your personal data is required to preserve your life or in an emergency, if it’s required to accomplish a public interest task or function, or if the function has a clear legal basis, we will handle it.

Examples of such information include personal information about your ethnic origin or sexual orientation.
  • If you are under the age of sixteen, you may not give us your personal information without your parent’s or another adult caregiver’s agreement. We do not intentionally gather or handle children’s personal data.
